The author maintains in this article that it is possible an approach between the positivistic legal theory, the one that follows the model of the analytical theory developed by Hart, and those others that apply a socio-legal method. Against what some defenders of both perspectives advocate, who view each others with some disdain, the author asserts the need to integrate legal theory with social sciences in the field of juridical ideas. This supposes opening spaces to develop a socio-legal theory of (...) law that lives equally from categories of conceptual analysis and of sociological research. The author rests specially, in order to defend this position, on authors like Roger Coterrell, Denis Galligan, Nicola Lacey and, above all, Brian Tamanaha and William Twinning, whose arguments are here object of special consideration. ABSTRACTPrior research has found a relationship between perceived facial attractiveness and perceived personal trustworthiness. We examined the time course of attractiveness relative to trustworthiness evaluation of emotional and neutral faces. This served to explore whether attractiveness might be used as an easily accessible cue and a quick shortcut for judging trustworthiness. Detection thresholds and judgment latencies as a function of expressive intensity were measured. Significant correlations between attractiveness and trustworthiness consistently held for six emotional expressions at four intensities, and neutral (...) faces. Importantly, perceived attractiveness preceded perceived trustworthiness, with lower detection thresholds and shorter decision latencies. This reveals a time course advantage for attractiveness, and suggests that earlier attractiveness impressions could bias trustworthiness inferences. Assessing physical fitness has emerged as a proxy of the health status of children and adolescents and therefore as relevant from a public health point of view. DAFIS is a project included in Plan Galicia Saudable of the regional government of Galicia. DAFIS consists of an on-line software devoted to record the results of a standard physical fitness protocol carried out as a part of the physical education curriculum. The aims of this study were: to obtain normative values of physical (...) fitness of the Galician school population evaluated in the DAFIS project, and to identify a reduced number of components and tests able to capture a significant amount of the variability in the physical fitness of children and adolescents. From an initial sample of 27784 records, 15287 cases were considered after filtering. Generalized Additive Models for Location, Scale and Shape were used for obtaining percentile curves and tables for each sex. Furthermore, a principal components analysis was performed, selecting the number of components by applying the Kaiser’s rule and selecting a subset of variables considering the correlation between each variable and the components. Percentile curves and normative values are reported for each test and sex. Physical fitness was better in boys than in girls throughout age groups, except for flexibility that was consistently higher in girls. Two main components were detected throughout age groups: the first one representing body composition and partially cardiorespiratory fitness and the second one muscular fitness. For boys and girls, waist to height ratio had the highest correlations with the first component in four out of six age groups. The highest correlation with the second component, was most frequently observed for the handgrip test both in boys and girls. This study provides evidence about the utility of school community actions like DAFIS aimed to track the health-related fitness of children and adolescents. The results suggest that fat mass distribution and muscular performance concentrate a high proportion physical fitness variance. (shrink)

This paper argues that the normative character of our unreflective situated behaviour is not factual. We highlight a problematic assumption shared by the two most influential trends in contemporary philosophy of cognitive science, reductionism and enactivism. Our intentional, normative explanations are referential, descriptive or factual. Underneath this assumption lies the idea that only facts can make true or false our attributions of cognitive, mental and agential abilities. We will argue against this view by describing the main features and problems of (...) reductionism and enactivism and then we will offer two arguments against this shared factualist assumption: (1) normative vocabulary is ineliminable if we want a complete explanation of our situated practices; and (2) the factualist assumption is a species of the is-ought fallacy. Finally, we will claim that a folk psychological explanation of our normative practices is fully compatible with ontological naturalism when such descriptivist or factualist assumption is rejected. Wittgenstein distinguished between two uses of “I”, one “as object” and the other “as subject”, a distinction that Shoemaker elucidated in terms of a notion of immunity to error through misidentification (“IEM”); first-personal claims are IEM in the use “as subject”, but not in the other use. Shoemaker argued that memory judgments based on “personal”, episodic memory are not strictly speaking IEM; Gareth Evans disputed this. Similar issues have been debated regarding self-ascriptions of conscious thoughts based on first-personal awareness, in (...) the light of claims of “thought insertion” in schizophrenic patients. The paper aims to defend a Shoemaker-like line by critically engaging with some compelling recent contributions. Methodologically, the paper argues that to properly address these issues the all-inclusive term “thought” should be avoided, and specific types of thoughts countenanced. (shrink)

The truth of a statement depends on the world in two ways: what the statement says is true if the world is as the statement says it is; on the other hand, what the expressions in the statement mean depends on what the world is like (for instance, on what conventions are in place). Each of these two kinds of dependence of truth on the world corresponds to one of the dimensions on the two-dimensional semantic framework, developed in the 1970’ (...) in the work of Evans, Kaplan, Kripke and Stalnaker. The introduction provides a systematic overview of the framework, the ideas of its earlier originators, recent developments and criticism. Evans (1979) replied that, for a very specific sort of cases involving “descriptive names”, a related proto-two-dimensionalist account should be preferred, on which it is not the singular contingent content, but rather a general descriptive one which is knowable a priori. In a series of papers, Robin Jeshion (2000, 2001) has recently attacked Donnellan's proposal, arguing in favour of the most straightforward interpretation of Kripke's claim: in the relevant cases, the very same singular content can be both contingent and knowable a priori. This paper appeals to a generalized version of two-dimensional semantics to advance an account of the Kripkean cases along the lines of Evans's, and argues that Jeshion's compelling arguments against Donnellan's view do not apply to this version. In this paper, we analyze the origin of the links between global bioethics (which we differentiate from biomedical bioethics) and human rights. We understand that we are in a global civilizational crisis, whose roots extend to 1492 today, in which the modern-capitalist model used the discourse of human rights to justify its predatory technocracy. There are three theoretical assumptions that support our analysis: 1) The current conditions in which the technique shows its destructive power over nature (Anthropocene) indicate that none (...) of the ethical antecedents are applicable to such circumstances. In this new context, the kantian categorical imperative has been reconverted into a moral and political duty to not instrumentalize either human beings or nature. We call this new ethical consideration bioethics. 2) The current geopolitical composition of the world must be thought in terms of the global North and the global South, as two regions that are forged in the midst of important processes of globalization of the world-system, and whose main consequence lies in the absence of equity in the distribution of wealth and well-being between the two. 3) The current environmental crisis or climate change, the product of an economic model based on extractive technology, has become one of the most serious threats against human rights. This article sets out a global analysis of the weaknesses, threats, strengths and opportunities that define the current situation of nursing in Europe. The nursing profession in Europe is suffering from a crisis of self‐efficacy with the syndrome of burnout being one of its consequences. Other weaknesses include shortage of staff, job insecurity, devalued nursing image in society and the lack of recognition of emotional and psychological dimensions of care. The threats to this profession are linked to the lack of (...) prestige and social recognition and to the current economic crisis in Europe. The European economic crisis favours staff shortages and increased European migration flow. The strength of the group lies in the art of caring, which is its defining feature. Primary Care Nursing and Hospital Liaison Nursing demonstrate the great professional adaptability in meeting the needs of the ever‐changing society. The European Higher Education Area and the strengthening of the specialties provide opportunities for the nursing profession. Both represent an important progress towards solid professionalism that will give nursing greater visibility. Moreover, nursing must implement strategies to disseminate its activity and emerge from anonymity. Nursing must show society the image it wants to project. (shrink)

Introducción: la formación de profesionales competentes es una de las misiones esenciales de la Educación Médica Superior, esto exige que los tecnólogos posean habilidades comunicativas para un correcto desempeño laboral en aras del mejoramiento humano. Objetivo de la investigación: identificar las barreras que inciden en la comunicación tecnólogo - paciente en las carreras de Licenciatura en Traumatología, Podología, Terapia Física y Rehabilitación Social Ocupacional, en áreas de rehabilitación. Métodos: se presenta un estudio observacional, descriptivo longitudinal y retrospectivo entre junio de (...) 2008 y junio 2011 que consistió en la observación a exámenes estatales prácticos y a la educación en el trabajo, en las carreras de referencia, además se aplicó una encuesta a pacientes para la obtención de información acerca de las barreras que afectan el proceso de la comunicación entre tecnólogos y pacientes. Resultados: existen insuficiencias en la comunicación entre los futuros profesionales y pacientes. Conclusiones: se demuestra un insuficiente dominio de las habilidades comunicativas y por tanto barreras que interfieren en la comunicación como las semánticas y personales. Introduction: the training of competent professionals is one of the essential missions of higher medical education; this requires that technologists have communication skills in order to develop a proper job performance for the sake of human improvement. So the objective of the research is to identify barriers affecting technologist - patient communication in the careers of degree in Trauma, Podiatry, Physical Therapy, and Occupational Social Rehabilitation in areas of rehabilitation. Methods: an observational, longitudinal descriptive and retrospective study is presented between June 2008 and June 2011 that consisted on observation to practical state exams and training at work, in the reference degrees; in addition, a survey was applied to patients to obtain information about the barriers that affect the communication process between technologists and patients. Results: there are communication inadequacies between the future professionals and patients. Conclusions: An insufficient mastery of the communication skills is demonstrated and therefore barriers that interfere with communication as the semantic and personal barriers. (shrink)

Patina is the word used for the green or brown film formed on the surface of old bronze, an excess of which can mask the true characteristics of the original masterpiece. Filippo Baldinucci used the word patina in a modern sense for first time in his book “Tuscan Vocabulary of the Art of Design”. Metaphors have been part of philosophical speech since the time of Plato. This figure of speech is used to attempt to provide a sensitive presence of an (...) idea to improve understanding and to make a more vivid perception of that concept. On analysing the creative process of contemporary re-search on health topics and its further dissemination, we defend the epistemological thesis that there is always some degree of patina on an original article and this may obscure the underlying scientific work. Conclusion: We consider that patina in scientific papers is very different from the concept of epidemiological bias. We think that any researcher who reads an original article acts as a restorer of knowledge. If a reader is aware of the existence of scientific patina, that reader will know how to look through it and see the masterpiece hidden underneath. (shrink)

Based on a deliberative democracy, this book uses a hermeneutic-critical methodology to study bibliographical sources and practical issues in order to analyse the possibilities, limits and consequences of the digital transformation of democracy. Drawing on a two-way democracy, the aim of this book is intended as an aid for thinking through viable alternatives to the current state of democracy with regard to its ethical foundations and the moral knowledge implicit in or assumed by the way we perceive and understand democracy. This paper aims to enhance security in IoT device networks through a visual tool that utilizes three projection techniques, including Beta Hebbian Learning (BHL), t-distributed Stochastic Neighbor Embedding (t-SNE) and ISOMAP, in order to facilitate the identification of network attacks by human experts. This work research begins with the creation of a testing environment with IoT devices and web clients, simulating attacks over Message Queuing Telemetry Transport (MQTT) for recording all relevant traffic information. The unsupervised algorithms chosen provide a set (...) of projections that enable human experts to visually identify most attacks in real-time, making it a powerful tool that can be implemented in IoT environments easily. I defend a Deferred Ostension view of quotation, on which quotation-marks are the linguistic bearers of reference, functioning like a demonstrative; the quoted material merely plays the role of a demonstratum. On this view, the quoted material works like Nunberg’s indexes in his account of deferred ostensión in general. The referent is obtained through some contextually suggested relation; in the default case the relation will be … instantiates the linguistic type __, but there are other possibilities. In this way, the (...) deferred ostension view deals with a problem I pointed out for the identity proposal in my earlier work, that we do not merely refer with quotations to expression-types, but also to other entities related in some way to the relevant token we use: features exhibited by the token distinct from those constituting its linguistic type, features exhibited by other tokens of the same type but not by the one actually used (as when, by using a graphic token, we refer to its phonetic type), or even other related tokens (see the examples on p. 261 of García-Carpintero 1994). Alternative splicing (AS) is a widespread mechanism with an important role in increasing transcriptome and proteome diversity by generating multiple different products from the same gene. Evolutionary studies of AS have focused primarily on the conservation of alternatively spliced sequences or of the AS pattern of those sequences itself. Less is known about the evolution of the regulation of AS, but several studies, working from different perspectives, have recently made significant progress. Here, we categorize the different levels of AS evolution, (...) and summarize the studies on evolution of AS regulation, which point to a high level of evolutionary conservation of the regulation of AS events conserved between related species. This suggests that the quantitative regulation of AS is an intrinsic part of AS function. We discuss the potential role of changes in developmental regulation of AS as an additional layer in complex gene regulatory networks and in the emergence of genetic novelties. (shrink)

The distinction between personal level explanations and subpersonal ones has been subject to much debate in philosophy. We understand it as one between explanations that focus on an agent’s interaction with its environment, and explanations that focus on the physical or computational enabling conditions of such an interaction. The distinction, understood this way, is necessary for a complete account of any agent, rational or not, biological or artificial. In particular, we review some recent research in Artificial Life that pretends to (...) do completely without the distinction, while using agent-centred concepts all the way. It is argued that the rejection of agent level explanations in favour of mechanistic ones is due to an unmotivated need to choose among representationalism and eliminativism. The dilemma is a false one if the possibility of a radical form of externalism is considered. (shrink)

There seems to be a distinction between primary and secondary properties; some philosophers defend the view that properties like colours and values are secondary, while others criticize it. The distinction is usually introduced in terms of essence; roughly, secondary properties essentially involve mental states, while primary properties do not. In part because this does not seem very illuminating, philosophers have produced different reductive analyses in modal terms, metaphysic or epistemic. Here I will argue, firstly, that some well-known examples fail, and (...) also that there are deep reasons why such approaches should do so. Secondly, I will argue that it is acceptable to remain satisfied with the non-reductive account in terms of essence. To that end, I will indicate how such an explication could be put to use to support the claim that properties like colours and values are secondary. In a series of recent writings, Kit Fine has argued that essence cannot be reductively analysed in modal terms. Fine offers some examples to motivate his claim. I suggest that the primary/secondary distinction constitutes a philosophically interesting illustration. (shrink)

Este artículo se propone confrontar el concepto de opinión pública con la realidad y las expectativas de una sociedad digitalizada para analizar si la actual colonización algorítmica exige un nuevo cambio estructural de la opinión pública o más bien la retirada de este concepto. Los datos y metadatos masivos se han vuelto un arma de doble filo para la sociedad democrática digitalmente hiperconectada. Mientras que, por un lado, el increíble potencial que atesora el _big data_ y sus diferentes técnicas y (...) tecnologías de explotación de los datos y metadatos lo convierten en un producto codiciado por sistema de instituciones que componen tanto el estado como la sociedad civil; por otro, los altos impactos negativos que su uso instrumental e irresponsable está produciendo y puede llegar a producir, hacen del _big data_ una herramienta controvertida y altamente criticada por alejarnos de cualquier intento de construir una ciudadanía digital. Si bien la democracia algorítmica no se apoya solo en la opinión pública, el objetivo es mostrar la incompatibilidad entre opinión pública artificial y democracia. Nuestro hilo conductor es el concepto habermasiano de opinión pública, puesto que será precisamente la fuerza de la sociedad civil, a través del diseño en su seno de espacios de participación, de donde podemos extraer el potencial necesario para enfrentarnos a la actual colonización algorítmica, para recuperar una deliberación autónoma y crítica sin la cual no existe opinión pública alguna y, por tanto, tampoco democracia. We present a module based criterion, i.e. a sufficient condition based on the absolute value of the matrix coefficients, for the convergence of Gauss–Seidel method (GSM) for a square system of linear algebraic equations, the Generalized Line Criterion (GLC). We prove GLC to be the “most general” module based criterion and derive, as GLC corollaries, some previously know and also some new criteria for GSM convergence. Although far more general than the previously known results, the proof of GLC is simpler. (...) As it is well known, mobile phones have become a basic gadget for any individual that usually stores sensitive information. This mainly motivates the increase in the number of attacks aimed at jeopardizing smartphones, being an extreme concern above all on Android OS, which is the most popular platform in the market. Consequently, a strong effort has been devoted for mitigating mentioned incidents in recent years, even though few researchers have addressed the application of visualization techniques for the analysis of (...) malware. Within this field, the present work proposes the extension of a new technique called Hybrid Unsupervised Exploratory Plots to visualize Android malware datasets. More precisely, the novel Beta-Hebbian Learning (BHL) method is applied for the first time and validated under the frame of Hybrid Unsupervised Exploratory Plots, in conjunction with clustering methods. The informative visualization achieved provides a picture of the structure of the malware families, allowing subsequent analysis of their organization. To validate the Hybrid Unsupervised Exploratory Plot extension and its tuning, the popular Android Malware Genome dataset has been used in the experimental setting. Promising results have been obtained, suggesting that BHL applied in combination with clustering techniques in Hybrid Unsupervised Exploratory Plots are a viable resource for the visualization of malware families.
